A young woman backing her car out of a driveway collided with me towards the bottom of a hill, causing me to fall onto the roadway.  I was hospitalised for 3 days with an acromioclavicular (AC) joint separation in my right shoulder (my arm was in a sling for 5 weeks, & is still not fully healed) and a large haematoma in my left abdomen (drained by surgery two weeks later).  The young driver was very apologetic in the hours & weeks after the incident. The police report indicated that the car driver was at fault - I was advised that she was fined for negligent driving.  My medical costs have been covered by the NSW Compulsory Third Party (CTP) scheme. An ultrasound & acoustic examination by Carbon Bike Doctor in Mona Vale, Sydney, revealed that the down tube, fork steerer & front wheel on my Focus carbon fiber bike were irreparably damaged, so I've had to replace them.  It took several months to arrange the examination of the bike, since I my arm was in a sling 5 weeks after the accident. The driver is refusing to claim against her comprehensive car insurance to cover the costs, because she considers that I took too long to have the bike examined (& so believes I am trying to scam her) and she is unemployed.  Small claims court action may be necessary.
